Kobe is a BIG dude in the NBA. Kate Faber is almost a foot shorter than him. She's had heard about dating blacks, but never been until the first with Kobe. It's a likely defense that makes it understandable for her to ask want to try for the first time but after a few minutes of much pain from size requested Kobe to stop for which he complied.
I really don't see this a CRIME, but simply a misunderstanding.
