Hi folks. I'm usually limited because of time restraints and subject interests so I apologize for being presumptive starting a thread after just joining. I have some definite opinions about this subject, the judge's interpretation, and perceptions in society, and would be interested to read some of yours after reading the article.

I'd like to first preface this by asking a question. If a child was playing ball in their yard and the adult neighbor claiming to be fed up with the noise displayed full frontal nudity during the activity... should the person be prosecuted?

Now what if the child is a 14 year old boy and the neighbor is a 40 year old woman?


RIVERSIDE, Calif. - A judge dismissed an indecent exposure charge against a woman accused of disrobing in front of a 14-year-old boy, saying the law only applies to men.

Superior Court Judge Robert W. Armstrong said earlier in the week that the law only mentions someone who "exposes his person."

"It's gender specific," Armstrong said.

He dismissed a misdemeanor charge against Alexis Luz Garcia, 40, of Corona, who was cited in May after parents of a neighbor boy said she showed him full-frontal nudity as he played basketball.

Prosecutor Alison N. Norton said the decision to throw out the case will be appealed because another section of state law says that "words used in the masculine gender include the feminine and neuter."
Norton said Garcia had complained that the 14-year-old was making too much noise while playing basketball. She went out on her sundeck.

"He looked up at her, she looked down at him, and she disrobed," Norton contended.

The boy ran inside and told his parents, who complained to Garcia.

"She threatened to do it every time he played basketball," and the parents called police, Norton said.

I'm don't think she should do time unless she has a history of pedophile behavior. I do think she should be fined. I completely agree with you about the judge's ruling. Its almost hard to believe she could misread the intent but given perceptions in our society as far as who and what fits the definition I'm not totally surprised. With my own bias, if the sex roles were reversed in this case I would be more inclined to give a 40 year old man time in jail. I know that is a bias but I'm not too sure its completely wrong. In other words I'm still not sure, given the uniqueness of each situation, an adult female does as much harm as an adult male. If you remember the case not long ago of the attractive blond female teacher and her teen male student, I know if I was in his shoes when I was 15 I would have gone out of my skin. It would have been awesome. Granted, I don't know if I would have been scarred later in life.

yeah, I think that judge in that case you are talking about told her she was too pretty to do jail time. My argument though is that whether the boy liked it or not, when parents send kids to school, the government makes them do it, so the classroom should not be a place where predators can choose who they want to have sex with.

Even if the youngster enjoys it and wants it, I think that teacher should have went to jail. Forget her name, remember her blond hair.


This lady above doesn't fit the typical pedophile profile, she just sounds like a very angry stupid woman, who was pissed off and used her (probably fat and ugly) body to punish him. It would almost be funny. I don't think she was out to molest him, but her goal was to horrify him. I dunno, I have not seen a picture of her yet.

A woman gets not so much as a slap on her hand.

I realize to the guys that it doesnt seems such a big deal...but as long as we put it out that its okay for one gender and not the other, then problems are going to arise.

I say this lady needs to be placed in the books as a sexual predator...a guy would have to in this case...and I think she should as well.

And being that I am a woman....there you have it!

I think that the way we prosecute sex crimes in this country is really messed up. Women get away with having sex with minors and that is plain wrong. The gender of the offender should not matter at all. It should all be based upon the crime.

I just calls 'em how I sees 'em. The random flash from a chick is the best. For some reason, when I worked at a video store just out of high school chicks would flash us frequently. It was glorious.

One night for instance, when I was a shift manager at a Blockbuster, we were doing inventory after close. Almost everyone that worked there hung out all the time. That's a batch of stories I could get into another time. But we were outside having a smoke at 2am, drinking a beer, when these chicks cruised through the parking lot, about four of them in a convertable and flopped the boobs out while honking and yelling. It was great.

A different night I was closing and these two chicks were banging on the window because they wanted to get a movie. I told them the computer was off, nothing I could do, when one pressed those puppies against the window so I would let her in. Good times.
