June 6, 2005 The federal government has the power to prevent sick patients from smoking home-grown marijuana that a doctor recommended to relieve their chronic pain, the U.S. Supreme Court ruled on Monday.
The high court decided that a federal law outlawing marijuana applied to two seriously ill California women, even though California is one of at least nine states that allow medical use of marijuana.
Justice John Paul Stevens said for the court majority that the federal law, the Controlled Substances Act of 1970, was a valid exercise of federal power by the Congress "even as applied to the troubling facts of this case."

another win for the neo-conservatives. Old conservatives believed in smaller federal government and state's rights.
not so with this new brand of conservatives that seem to want to use federal power to control everything.
Well I guess this means that Montel Williams will either be arrested or will have to fore go his medicine.
this is another sign of the republicans putting their judgment
ahead of what is right or wrong (which has been mostly wrong lately)
ahead of common sense. (Bush's stem cell veto comes to mind also.)
In a hundred years when all the bush supporters (who seem to be blinded to reality and defend every idiotic thing he does) are gone, History will record George W. Bush as the worst president in the history of U.S. presidents
