I cant guarantee that #5 (the foreman) was...but the consensus, is that #7 was a definite not guilty...(but like I said, that was the buzz yesterday..) Whether its true or not is beyond me.

Question for you all: Would you rather go for a mistrial or a verdict?
Should be interesting.
Personally, Id rather have the verdict...if they come back with a guilty verdict...there is definite grounds for appeal (depending on WHY he kicked off 2 jurors in two days)...
If they have a hung jury...UGH...that means starting all over again..

The worst scenario is when the Judge puts his two cents in too much and spoils it for both sides. Then the jury is contaminated with bad evidence or bench instructions which violates the defendant's Constitutional fair trial. When that happens, neither side who worked so hard for so long can salvage the remaining trial.

So was Judge Delucchi who thought he had "the most important trial of the decade" better or worst than Judge Ito in the OJ trial? This happens a lot in California, the State of Fruits and Nuts. And so goes defense Appeal if convicted, but DA can not appeal if acquittal. Mistrial - start over.... and it's a lose - lose proposition for everyone. Well, at least for the taxpayers but not for the correctional guards, the local tourist trade, the media and legal analysts and people getting overtime.
