Prosecutors in MICHAEL JACKSON's child molestation case are facing a devastating blow, following reports his teen accuser GAVIN ARVIZO's mother is considering not taking the stand.
JANET ARVIZO is reportedly concerned about potential legal problems from her past if she testifies, putting the conspiracy case against Jackson in serious jeopardy.
In a motion filed under seal, sources close to both sides tell ABC NEWS that the prosecution has asked that the defence be prevented from asking the woman any questions about welfare fraud.
Santa Barbara District Attorney TOM SNEDDON had admitted in opening statements there was a problem, telling the jury, "She obtained welfare funds and wasn't entitled to them. She's going to tell you that and she's going to admit that."
But now ABC News reports that she has changed her mind and wants to admits nothing, threatening to take the Fifth Amendment, which would put the rest of her testimony in jeopardy.
Janet, who was expected to testify this week, never saw any sexual molestation of her 15-year-old son, but is a key witness on the rest of the case - the alleged to conspiracy to keep the accusing family at Neverland and to spirit them away to Brazil.
The judge still has to rule on the sealed motion that will determine how the defence will be able to question the accuser's mother on certain things, if she takes the stand at all.
Jackson, 46, has pleaded not guilty to 10 felony charges of child molestation, administering an intoxicating agent and conspiracy involving allegations of child abduction, false imprisonment and extortion.
