The former guard, Ralph Chacon, testified that Jackson and the boy -- who was involved in a civil suit against Jackson in 1993 -- were engaged in "passionate" kissing and were caressing before the sex act.

The 46-year-old singer is accused of molesting another boy -- now 15 years old -- at Neverland, giving him alcohol and conspiring to hold the boy's family captive in 2003.

Jackson has pleaded not guilty to the charges.

"[Jackson's] hands were all over his body," Chacon said of the incident outside the shower in late 1992 or 1993.

The family of the boy, who was 9 or 10 at the time of the incident, filed a civil lawsuit against the entertainer 12 years ago. Without admitting guilt, Jackson agreed to a multimillion-dollar settlement to end that case.

Chacon's testimony marks the first time in this trial that jurors have heard allegations of sexual contact that went beyond fondling or masturbation.

He witnessed this in 1993 or 1994? And this is the first anyone is hearing of it? I don't care if you signed a confidentiallity clause, there is such a thing as the greater good and this guy should have gone straight from seeing that shower scene to the Police.

Can he be charged with endangering the child's safety through negligence or something for not coming forward with this information sooner?

But MJ has some serious fans that will kill, so I guess if you make statements like that against him you best be prepared to pack up and leave the country. I think thoes people really had to sign a confidentiality contract, that a lot of former employees claim they had to sign. But that must be some powerful S**T in thoes contracts to not report a scene like that.

I remember hearing that he did go to the police with this, but then the kid would not testify because of the settlement. Still, how could you walk in on that and not say "GET YOUR F'ing HANDS OFF THAT CHILD!" There is no way in hell I could see that and not go stop it.

The defense is arguing that these are disgruntled ex employees who are making these allegations out of a need for revenge. The problem I have with this is no matter how screwed I ever got from a former employer, (and there have been a few times) I would never falsify this kind of charge or allegation. Some things are just beyond revenge and I think this is one of them. Besides, these former employees would have to collaborate on their different "stories" to make them similar enough for the DA to take interest.

Like Sherry said though, how can you witness something like that and NOT speak up? Maybe MJ's money and power is too intimidating to those around him.

so true, no one would really know how to react to something like that, espically under thoes circumstances. I would tell someone, but who???? I mean going to the cops on MICHAEL JACKSON is a very difficult thing because you are opening a giant can of worms and your private life is over.
