There is no such thing as an activist judge, that's just a term Bush uses for judges following the Constitution. The will of the people isn't always right. Jim Crow laws were the will of the people in the south, "activist" judges changed those unconstitutional laws.
It's just a political buzz word to whip the base up into a frenzy.
